This Privacy Policy explains how UTM.io and its affiliates (“us”, “we”, or “our”) use and disclose information that we collect from people who visit our websites, including without limitation utm.io (the “Website”), or who use any of our applications, products, or services (“Services”). While no transmission of information over the Internet is 100% secure, we work very hard to protect information about you against unauthorized access, use, alteration, or destruction, and take appropriate and reasonable measures to do so. 10. Users Outside of the US

Please note that we are a U.S. company with U.S. operations. When you use our Website or Services, your information will be sent to the U.S. The data protection and other laws of the U.S. and other countries might not be as comprehensive as those in your country, and do not provide for an adequate level of data protection based on European Commission standards. In the U.S., there may be no applicable supervisory authority, data processing principles, or data subject rights in respect of your personal data. You represent that you have been informed of these risks and you explicitly consent to the transfer of your personal data to the U.S., for the purpose of accessing the Website and Services. You also understand and agree that such transfer is necessary for us to provide Services to you in accordance with our Terms of Use.

11. Users in the EU

This subsection applies solely to users of the Website and Services in the EU. To the extent that the European General Data Protection Regulations (GDPR) apply (which is determined by variables such a type of Services used, when and where used Services are used, what type of data is transmitted or received via the Services, etc.), we will only collect and process your personal data where we have a legal basis for doing so under the GDPR. Legal bases include consent (where you have given consent) and contract (where processing is necessary for the performance of a contract with you (e.g. to deliver Services you have requested)).
